All praise is due to Allah. May the peace and blessing be upon the messenger of Allah, His household, companions and patrons. To proceed:
This is to acknowledge that this question was submitted by the honorable Dr. Main Al-Qudah to the AMJA permanent Fatwa committee after he received a chain of rejoinders and comments a propos his earlier answer to the aforementioned question.
He extradited the whole issue to the AMJA permanent committee which expressed its reservation about his answer and responded with the attached Fatwa
In the name of Allaah, the Benevolent, the Merciful. All praise is due to Allaah, and may peace and blessings be upon the messenger of Allaah, his family, companions, and those loyal to him. The default with regards to the likes of this are Allaah's words: "You shall help one another to virtuousness, and to the fear of God. But you shall not help one another to sin and to aggression..." 05: 02
So whoever is upon virtuousness and piety, he should be aided to achieve more of it, and whoever is upon sin and transgression, he shouldn't be aided to achieve that. This applies on every Land and under every sky, irrespective of being a civilian or a soldier and regardless their national or religious allegiance. The emigrant Muslims during the time of prophethood had supported the king of Abyssinia, and fought on his side against those who transgressed and plotted against him. Based on this tenant and its applications at the time of prophethood, the verdict should be construed. Allaah, the Most High, knows best.
